Overview
Welcome to No Duff.
The terms “we”, “us” and “our” refer to No Duff. These Terms of Service govern your use of our website, online store and related services, including purchases made through the store.
No Duff is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and services to you.
By accessing our website, creating an account or placing an order, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not use the website or our services.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights available under the Australian Consumer Law and any applicable New Zealand consumer law.
1. Eligibility and accounts
You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to make a purchase through our store.
You agree to provide accurate, current and complete information when placing an order or creating an account.
You are responsible for keeping your account details and login credentials secure. Please notify us promptly if you believe your account has been accessed without authorisation.
You must not transfer, sell or assign your customer account to another person.
2. Product information
We take reasonable care to ensure that product descriptions, specifications, photographs and other information displayed on our website are accurate.
Colours and product appearance may vary slightly depending on lighting, photography, screen settings and the device used to view the website.
Certain T-shirts are produced on demand according to the size, colour and design selected when the order is placed. Customers should review these selections and the applicable size guide carefully before ordering.
Minor differences may occur between digital mock-ups and the finished product because of garment texture, production processes, lighting, photography and screen display. This does not limit your rights where a product is faulty, incorrectly produced, materially different from its description or otherwise fails to meet an applicable consumer guarantee.
Product availability, specifications and descriptions may change before an order is accepted. Changes made after an order has been accepted will not alter the product you agreed to purchase without your consent.
We may discontinue products or reasonably limit the quantity available for purchase.
3. Orders and acceptance
Placing an order is an offer to purchase the products listed in your order.
An order is accepted when we send confirmation that it has been accepted or dispatched. An automatically generated order acknowledgement does not necessarily mean that the order has been accepted.
We may decline or cancel an order where, for example:
- a product is unavailable;
- the price or product information contains a genuine error;
- payment cannot be authorised;
- delivery is unavailable to the nominated address;
- we reasonably suspect fraud, unlawful activity or unauthorised commercial resale; or
- accepting the order would breach a legal or regulatory requirement.
If we cancel an order after taking payment, we will provide a full refund for the cancelled items and any associated shipping charges.
Please review your order—including the selected product, size, colour, design and delivery address—carefully before submitting it.
You may request cancellation by contacting hello@noduff.com.au as soon as possible.
For stocked products, we will make reasonable efforts to cancel the order before processing or dispatch begins. Cancellation cannot be guaranteed once processing has begun.
Print-on-demand products can only be cancelled or changed if production has not begun and our fulfilment provider can successfully stop or modify the order. Once production begins, changes or cancellations cannot ordinarily be made.
If an order is successfully cancelled before processing or production begins, we will refund the applicable payment to the original payment method.
Returns and refunds remain subject to our Returns and Refunds Policy and any rights available under applicable Australian or New Zealand consumer law.
4. Prices and payment
Prices are displayed in the currency applicable to the customer’s selected market. This currently includes Australian dollars for Australian customers and New Zealand dollars for New Zealand customers.
Prices include applicable taxes where required.
Prices displayed in a currency other than our store currency may be calculated using a dynamic exchange rate and may change as exchange rates change.
Shipping charges and any other applicable costs will be displayed before you complete checkout. The price and currency displayed at checkout are the amounts applicable to your order.
Prices, promotions and product availability may change without notice before an order is placed. The price applying to an accepted order will be the price shown at checkout unless there has been an obvious error that we address in accordance with these Terms.
Promotions may be subject to separate terms. Where promotional terms conflict with these Terms, the promotional terms will apply to that promotion.
You agree to provide accurate billing and payment information and confirm that you are authorised to use the chosen payment method.
5. Shipping and delivery
Shipping destinations, options, charges and estimated delivery timeframes are described in our Shipping Policy and displayed at checkout.
Product availability and shipping options vary by destination. Selected print-on-demand T-shirts are currently available for delivery within Australia and New Zealand. Other products may have different delivery restrictions.
Products may be fulfilled from different locations. Print-on-demand T-shirts may be produced and shipped separately from stocked No Duff products, including Utility Caps.
An order may therefore:
- arrive in more than one parcel;
- arrive on different days;
- generate separate tracking notifications; and
- include shipping charges applicable to different fulfilment locations.
Delivery timeframes are estimates rather than guaranteed delivery dates. Delays may occur because of production demand, carriers, severe weather, public holidays, customs processes, supply disruptions or other circumstances outside our reasonable control.
We will take reasonable steps to process and dispatch orders promptly and assist with delayed, lost or damaged shipments.
Risk in a product passes to you when it is delivered to the shipping address you supplied, left in accordance with your delivery instructions or collected by a person authorised by you.
You are responsible for providing a complete and accurate delivery address. Reasonable additional charges caused by an incorrect address or an unclaimed parcel may be payable by you.
Nothing in this section limits your rights where goods are not supplied within an agreed or reasonable time.
6. Returns and consumer rights
Change-of-mind returns, print-on-demand exclusions, cancellations and claims concerning faulty or incorrect products are governed by our Returns and Refunds Policy.
Print-on-demand products are produced specifically for each order. We do not offer change-of-mind returns or exchanges where the customer selected an incorrect size, colour or design.
This exclusion does not apply where a product is faulty, damaged, incorrectly produced, incorrectly supplied, materially different from its description or otherwise fails to meet an applicable consumer guarantee.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Customers in New Zealand may also have rights and remedies under applicable New Zealand consumer law, including the Consumer Guarantees Act and Fair Trading Act.
Nothing in these Terms or our Returns and Refunds Policy excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, restricted or modified.
7. Intellectual property
Unless otherwise stated, the content of this website—including our trademarks, logos, product names, photographs, graphics, written material, videos and website design—is owned by or licensed to No Duff.
This content is protected by Australian and applicable international intellectual property laws.
You may access and use the website for personal, non-commercial purposes. You must not reproduce, modify, distribute, sell, republish or commercially exploit our content without our prior written permission, except where permitted by law.
“No Duff”, our logos and associated brand elements must not be used without our prior written permission.
Shopify’s names, logos and associated marks belong to Shopify. Other trademarks displayed through the website belong to their respective owners.
8. Third-party services and links
Our website may use services, tools, applications or links supplied by third parties.
We use third-party providers—including Shopify, payment providers, fulfilment providers and delivery carriers—to operate the store and complete orders.
Third-party services may be governed by their own terms and privacy policies. We do not control independent third-party websites and are not responsible for their independent content, security or business practices.
Your use of a third-party website or optional third-party service is at your discretion.
Use of third-party fulfilment and delivery providers does not remove No Duff’s responsibility for assisting customers with products purchased directly from No Duff.
Nothing in this section excludes any responsibility that cannot lawfully be excluded.
Questions concerning products or services purchased directly from an unrelated third party should be directed to that third party.
9. Relationship with Shopify
No Duff is powered by Shopify, which enables us to provide our online store and related services to you. However, sales and purchases made through the No Duff store are made directly between you and No Duff.
By using the store, you acknowledge that Shopify is not the seller of No Duff products and is not responsible for fulfilling purchases made from No Duff.
To the extent permitted by law, you release Shopify and its affiliates from claims, damages and liabilities arising from or related to purchases and transactions made directly with No Duff.
Nothing in this section limits any right or remedy that cannot lawfully be excluded.
10. Privacy
Personal information collected through our website is handled in accordance with our Privacy Policy.
Our store is hosted by Shopify. Shopify processes certain information about your access to and use of the store so that it can provide and improve its ecommerce services.
Information may also be processed by Shopify, payment providers, fulfilment providers, delivery carriers and other service providers involved in operating the store and completing your order.
This may include processing information outside Australia or New Zealand.

11. Reviews and feedback
You retain ownership of reviews, photographs, suggestions and other content that you submit to us.
By submitting content, you grant No Duff a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for operating, improving and promoting No Duff and our products.
You confirm that you have the right to submit the content and that it does not infringe another person’s intellectual property, privacy or other rights.
Any payment, free product or other incentive connected with a review must be clearly disclosed.
We may decline to publish or may remove content that is unlawful, misleading, abusive, obscene, defamatory, unrelated to the product or otherwise breaches these Terms.
12. Errors and corrections
Occasionally, our website may contain typographical errors, inaccurate information or omissions relating to products, prices, promotions, availability, shipping charges or delivery estimates.
We may correct errors and update information.
If we discover a material error after you place an order, we will contact you and give you the choice of proceeding on the corrected basis or cancelling the affected item for a full refund.
We will not increase the price of an accepted order without your agreement.
13. Prohibited uses
You must not use the website or our services:
- for an unlawful or fraudulent purpose;
- to infringe our rights or another person’s rights;
- to harass, threaten, abuse or defame another person;
- to submit false or misleading information;
- to distribute spam, malware or malicious code;
- to obtain or collect personal information without authorisation;
- to interfere with the operation or security of the website;
- to circumvent access controls, security measures or purchasing limits; or
- to scrape, reproduce or commercially exploit website content without permission.
We may take reasonable technical measures to prevent misuse and protect our website, customers and systems.
14. Automated agents
An automated or semi-automated system accessing our services must identify itself accurately and must not impersonate a human user.
Automated systems must not circumvent CAPTCHAs, security controls, access restrictions, purchasing limits or other measures intended to protect our services.
We may limit or prevent automated access where reasonably necessary to protect customers, inventory, website performance, security or legal compliance.
15. Suspension and termination
We may suspend or terminate access to an account or service where we reasonably believe that:
- these Terms have been materially breached;
- fraudulent or unlawful activity has occurred;
- the security or operation of the website is at risk;
- suspension is required by law; or
- the relevant service has been discontinued.
Where reasonably practicable, we will provide notice and an opportunity to address the issue.
Suspension or termination will not remove rights or obligations relating to orders already accepted unless cancelling an order is reasonably necessary.
Where we cancel an accepted order without supplying the goods, any payment for the cancelled goods will be refunded.
16. Website availability and liability
We take reasonable care in operating our website but do not guarantee that access will always be uninterrupted, secure or error-free.
Nothing in these Terms excludes, restricts or modifies:
- rights or remedies available under the Australian Consumer Law or applicable New Zealand consumer law;
- liability that cannot lawfully be excluded; or
- liability for fraud, wilful misconduct or any other matter for which liability cannot be limited.
To the extent permitted by law, we are not responsible for loss caused by:
- your misuse of the website or a product;
- inaccurate information supplied by you;
- unauthorised access resulting from your failure to protect your account credentials;
- independent third-party websites or services outside our reasonable control; or
- events beyond our reasonable control.
We do not exclude liability for loss or damage that was reasonably foreseeable and caused by our failure to comply with an applicable consumer guarantee.
17. Indemnity
To the extent permitted by law, you agree to indemnify No Duff against a third-party claim arising directly from:
- your unlawful use of the website;
- content submitted by you that infringes another person’s rights; or
- your material breach of these Terms.
Your responsibility is limited to the extent that the claim was caused or contributed to by your conduct.
18. General terms
If part of these Terms is found to be invalid or unenforceable, that part will be severed or limited to the minimum extent necessary. The remaining provisions will continue to apply.
A failure or delay by either party to enforce a right does not waive that right.
You may not assign your rights or obligations under these Terms without our written consent.
We may assign these Terms as part of a genuine sale, transfer or restructure of the No Duff business, provided that doing so does not materially reduce your existing rights. We will give reasonable notice where appropriate.
These Terms, together with the policies referred to in them, constitute the agreement between you and No Duff regarding use of the website and purchases through the store.
19. Governing law
These Terms are governed by the laws of New South Wales and the Commonwealth of Australia.
You and No Duff submit to the courts with jurisdiction in New South Wales and Australia.
However, this provision does not exclude or restrict any mandatory right, protection, remedy or entitlement to bring a claim in another jurisdiction under applicable consumer law, including applicable New Zealand consumer law.
20. Changes to these Terms
We may update these Terms to reflect changes to our business, services, technology or legal obligations.
Updated Terms will be published on this page with an updated effective date. Material changes will be communicated where required by law.
Changes will apply prospectively and will not alter the terms applying to an order already accepted without your agreement.
Continued use of the website after updated Terms take effect constitutes acceptance of those updated Terms.
